Boater Briefer (“the App”), operated by Innealta LLC, provides a marine conditions dashboard that aggregates weather, tide, wave, and forecast data from third-party sources. The information presented is intended for general informational purposes only and should never be used as the sole basis for navigation, route planning, or any safety-critical decisions on the water.

Always consult official NOAA marine forecasts, National Weather Service advisories, U.S. Coast Guard notices to mariners, and your vessel’s navigation instruments before departing.

2. Data Accuracy

Weather, tide, wave, and marine forecast data displayed in the App is sourced from third-party providers including, but not limited to:

• National Oceanic and Atmospheric Administration (NOAA)
• Open-Meteo
• Apple Weather

This data may be delayed, incomplete, inaccurate, or unavailable at any time. Innealta LLC does not independently verify, guarantee, or warrant the accuracy, completeness, or timeliness of any data presented in the App. Conditions on the water can change rapidly and without warning.

3. AI-Generated Content

The safety briefings, condition summaries, and assessments provided by the App are generated by artificial intelligence (AI) models. These AI-generated outputs:

• May contain errors, inaccuracies, or misleading statements
• May produce hallucinated or fabricated information
• May not reflect the most current conditions
• Should not be treated as professional maritime advice

Audio versions of safety briefings are produced by text-to-speech (TTS) technology and carry the same limitations as written AI-generated content.

AI-generated content — whether text or audio — is provided as a convenience and does not constitute expert analysis. Always verify critical information through official channels.

4. No Warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. INNEALTA LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INNEALTA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO:

• Personal injury, property damage, or loss of life
• Damage to vessels, equipment, or cargo
• Decisions made in reliance on data or content from the App
• Loss of data, revenue, or profits
• Interruption of service or data unavailability

This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise, even if Innealta LLC has been advised of the possibility of such damages.

6. User Responsibility

You are solely responsible for your safety and the safety of your passengers and crew while on the water. Before every voyage, you should:

• Check official NOAA and National Weather Service marine forecasts
• Review U.S. Coast Guard notices and advisories for your area
• Ensure your vessel is properly equipped with required safety gear
• File a float plan with a responsible person on shore
• Maintain proper navigation instruments and charts
• Exercise sound judgment and seamanship at all times

7. Third-Party Services

The App integrates with and displays data from third-party services including, but not limited to, NOAA, Open-Meteo, Apple Weather, OpenCage, and GeoNames. Innealta LLC is not responsible for the availability, accuracy, or content of these external services. Your use of third-party data through the App is subject to those providers’ respective terms of service and policies.

Innealta LLC reserves the right to update or modify this Disclaimer at any time. Changes will be reflected by updating the “Last updated” date and version number at the top of this page. Your continued use of the App after any such changes constitutes your acceptance of the revised Disclaimer.
